Welcome to Aryaminer! The terms “we”, “us” and “our” refer to Aryaminer. We operate this website and online store, including all related information, content, features, tools, products, and services to provide you with a curated shopping experience (the “Services”). Our Services are powered by Shopify.
These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and obligations when using the Services. Please read them carefully.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your place of residence and that you consent to any minor dependents using the Services on devices you own or manage.
To use the Services, including browsing or purchasing, you may be asked to provide certain information (email address, billing, shipping, and payment details). You represent that all information you provide is true, current, and complete and that you have the right to provide it.
You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
2. PRODUCTS AND DESCRIPTIONS
We aim to display products accurately, but colors and appearances may vary depending on your device and settings. We do not guarantee that product appearance or quality will meet your expectations. Product descriptions may change at any time without notice, and we may limit quantities or discontinue products at our discretion.
3. ORDERS & NO RETURN POLICY
When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted only when we confirm and process payment. Please review your order carefully before submitting.
No Returns or Refunds:
All sales are final. We do not accept returns, exchanges, or refunds except as required by applicable law (for example, if a product is faulty, damaged or not as described at the time of delivery to the carrier).
4. PRICES AND BILLING
Prices, discounts, and promotions may change without notice. Unless otherwise stated, prices exclude taxes, shipping, handling, customs, and import charges. The price charged is the price at the time of order and will appear in your confirmation email.
You agree to provide accurate, current payment and account information. You represent that your card details are true, you are authorized to use it, and you will pay all charges at posted prices plus applicable taxes, shipping, and handling.
5. SHIPPING, TESTING AND RISK OF LOSS
Pre-Shipment Testing:
All devices (new and used) are fully tested at Aryaminer’s office before shipping to ensure they are in working condition. Upon customer request, a test video can be provided.
Risk of Loss:
Once the product leaves our facility and is handed over to the shipping carrier, title and risk of loss or damage pass to you. Aryaminer is not responsible for any loss, damage, or malfunction during transit or after delivery.
Please inspect your order immediately upon receipt and notify us within [X days] of delivery if you believe there is an issue that existed prior to shipment.
6. WARRANTY POLICY
New Devices:
All new devices include the original manufacturer’s warranty (e.g., Bitmain, MicroBT, etc.). Aryaminer honors and facilitates these manufacturer warranties according to their terms. Any warranty claims for new devices are handled under the manufacturer’s policies.
Used Devices:
Used devices are sold with testing and verification options agreed upon with the customer before purchase:

Testing in our Dubai office prior to shipment;

Receiving a test video before shipping; or
-
A limited test period (typically 7 days from first power-on) agreed upon and stated on the invoice.
This limited test period applies only if the device is received in the same condition as shipped and has not been damaged during shipping or mishandled after delivery.
7. INTELLECTUAL PROPERTY
All content and materials in the Services (including trademarks, text, images, graphics, video, audio) are owned by Aryaminer, its affiliates or licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. No license or rights are granted except as expressly stated.
8. OPTIONAL TOOLS
You may access third-party tools at your own risk. We provide such tools “as is” and “as available” without warranties or liability.
9. THIRD-PARTY LINKS
Our Services may link to third-party websites. We are not responsible for their content or practices. Review their policies before using those websites or purchasing from them.
10. RELATIONSHIP WITH SHOPIFY
Aryaminer is powered by Shopify. However, all sales and purchases are between you and Aryaminer. Shopify is not responsible for your transactions with us. You release Shopify and its affiliates from claims arising from your purchases with Aryaminer.
11. PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy. Some information is also processed by Shopify under its privacy policy: https://www.shopify.com/legal/privacy.
12. FEEDBACK
If you submit feedback, reviews, or suggestions, you grant Aryaminer a worldwide, perpetual, sublicensable, royalty-free license to use it for any purpose. You represent that you own the feedback and that it does not violate any third-party rights or contain harmful content.
13. ERRORS AND INACCURACIES
We may correct errors or update information at any time without notice, including after you submit an order.
14. PROHIBITED USES
You may not use the Services for unlawful purposes or in ways that harm Aryaminer, Shopify, or others. This includes uploading malicious code, scraping data, impersonating others, or infringing intellectual property. We may suspend or terminate accounts for violations.
15. TERMINATION
We may terminate or suspend your access to the Services at any time at our discretion. Sections intended to survive termination will continue to apply.
16. DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee uninterrupted, timely, secure, or error-free operation.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Aryaminer and its/Shopify’s affiliates, officers, directors, employees, agents, contractors, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or similar damages (including lost profits, data, or replacement costs) arising out of or related to your use of the Services or products.
18. INDEMNIFICATION
You agree to indemnify and hold harmless Aryaminer, Shopify, and their affiliates, officers, employees, and agents from claims and liabilities arising from your breach of these Terms or violation of law.
19. SEVERABILITY
If any provision is unlawful, void, or unenforceable, the remainder remains in effect.
20. WAIVER; ENTIRE AGREEMENT
Our failure to enforce a right is not a waiver. These Terms and the policies referenced here are the entire agreement between you and us.
21. ASSIGNMENT
You may not assign your rights or obligations without our written consent. We may assign or transfer these Terms without notice.
22. GOVERNING LAW
These Terms are governed by the laws of the United Arab Emirates, and the Courts of Dubai shall have exclusive jurisdiction.
23. CHANGES TO TERMS
We may update these Terms by posting changes here. We will notify you of material changes as required by law. Your continued use of the Services means you accept the changes.
24.Force Majeure
Aryaminer shall not be held liable or responsible for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, war, terrorism, labor disputes, embargoes, government actions or restrictions, sanctions, strikes, pandemic or epidemic, supply chain disruptions, shortages of materials, transportation or telecommunication breakdowns, or other similar events (each, a “Force Majeure Event”).
